The HEALS Act (Korean version)

HEALS 법안 발표

7월 27일 상원 공화당대표 미치 멕카넬이 코로나 바이러스에 대한 경제부양책인 the Health, Economic, Assistance, Liability Protection and Schools Act (“HEALS Act”)를 발의했다. HEALS Act가 법안이 되기 위해서는 상원과 하원의 민주당의 지지가 필요한 상황이기 때문에, 관련 법안이 통과가 되기 위해서는 민주당과 협의점을 찾아야 할 것으로 보인다. 따라서, HEALS Act가 통과할 때에는 발의된 법안과 차이가 있을 수 있다. 이번에 발의된 HEALS Act가 갖고 있는 큰 내용들은 다음과 같다:

Second Round of Paycheck Protection Program (PPP)

PPP 2차 지급: 고용하는 직원이 300명 미만이고 50% 이상의 총 매출 금액이 감소한 업체들의 경우에는 2차 PPP 대출을 신청할 수 있게 된다. 금액은 covered period의 월 급여비의 2.5배이며 최대 금액은 2백만불이다. 상환 감면을 신청하기 위해서는 60% 이상의 대출금이 급여비용으로 사용되어야 한다.

Expansion of Employee Retention Tax Credit (ERTC)

직원유지 크레딧 (Employee Retention Credit)의 확장 적용: 직원유지 크레딧이 확장되어 적용되게 되며 크레딧의 금액 기존 대상급여의 50%에서 65%로 인상된다. 대상급여 또한 연 $10,000에서 $30,000으로 증가된다 (하지만 분기별 $10,000으로 제한된다). 새로운 법안에 따르면, 500명 미만의 직원을 고용하는 업체는 확장적용되는 직원유지 크레딧을 신청할 수 있으며, 업체들은 PPP와 이 크레딧을 같이 신청 할 수 있다.

Extension of Work Opportunity Tax Credit (WOTC)

근로기회세액공제 (Work Opportunity Tax Credit)의 확장 적용: 근로기회 세액공제는 취업 취약계층을 고용한 사업주에게 보조금을 지급함으로써 해당 계층의 고용을 확대할 목적으로 도입된 제도이다. HEALS Act는 COVID-19으로 인하여 실업한 사람들을 취업 취약계층으로 설정하게 되며, 이에 따라 해당하는 인원을 고용하게 되면 첫번째 해의 급여 중 $10,000까지의 50%의 크레딧을 받게 된다.

100 Percent Deduction for Business Meals

비즈니스 식사 비용 100% 공제: 현재 세법 상 비즈니스 식사비용은 50% 공제가 된다. HEALS Act는 관련 법안을 일시적으로 완화시켜 2020년 12월 31일까지의 식사비용을 100%로 공제하게 되며, 이는 식당사업들의 영업활동을 촉진 시킬 수 있을 것으로 예상된다.

Liability Protection

책임법의 완화: HEALS Act는 과실에 대한 기준점을 높임에 따라 사업체, 학교, 의료기관 등이 COVID-19의 노출과 관련하여 과실에 대한 불법행위 및 의도된 불법행위에 대한 책임을 지는 것에 대해 면책권을 부여하게 된다. 하지만, 관련 법안에 대해 민주당은 우려를 표하고 있다.

Second Round of Stimulus Payment

2차 Stimulus Check 발행: 이 법안은 1차 Stimulus Check와 동일한 형태의 Stimulus Check를 제안하고 있다. 이에 따르면 1인 납세자는 $1,200의 체크가, 부부인 경우에는 $2,400의 체크를 받게 되며 부양가족 당 $500의 체크를 받게 된다. 1차와 마찬가지로 일정 수준 이상의 소득이 있는 납세자의 경우에는 수령하는 체크의 금액이 감소하게 된다 (1인 납세자의 경우에는 $75,000, 부부인 경우에는 $150,000).

Extension of Federal Pandemic Unemployment Compensation (FPUC)

연방 판데믹 실업급여(FPUC)의 연장: 이 법안은 연방 판데믹 실업급여를 2020년 9월까지로2개월 연장하며 금액은 주간 $600에서 $200으로 감소하게 된다. 2020년 10월부터 이 실업급여는 수령자의 기존 급여의 70%로 교체되며 이 금액은 주에서 수령하는 실업급여와 합쳐서 $500을 넘지 못한다.

Senate Republican announced on July 27, the Health, Economic, Assistance, Liability Protection and Schools (HEALS) Act providing Phase 4 economic stimulus package.  The HEALS Act will require Democratic support in both houses to be passed, and an uphill battle is expected in finalizing it for enactment as Democrats have their own agenda.  Therefore, the final bill may not incorporate all the provisions contained in the HEALS Act and may look very different from how they are being proposed by Republicans.  Here are some key provisions included in the HEALS Act:

Second Round of Paycheck Protection Program (PPP)

Businesses with fewer than 300 employees that have experienced at least a 50 percent reduction in gross revenue will be able to apply for second round of PPP loan equal to 2.5 times monthly payroll cost during the covered period, limited to $2 million.  To qualify for forgiveness, employers must use at least 60 percent of the loan to cover payroll costs.

Expansion of Employee Retention Tax Credit (ERTC)

Employee Retention Tax Credit eligibility will be relaxed and the credit amount will be increased.  Credit will be increased from 50% to 65% of qualifying wages and gross receipts threshold required to qualify would reduce to 25 percent from 50 percent.  Qualifying wage limitation will be increased from $10,000 per year to $30,000 per year, limited to $10,000 per quarter.  Under the new provision, eligible employers with fewer than 500 employees can claim ERTC.  Additionally, businesses would be able to claim both PPP and the ERTC.

Extension of Work Opportunity Tax Credit (WOTC)

The HEALS Act will add a new target group – COVID-19 unemployment recipients to the qualifying hiring criteria for WOTC.   The credit amount is 50 percent of the first $10,000 of first year wages of the qualifying hire.

100 Percent Deduction for Business Meals

Currently, business meals are only deductible 50 percent.  The HEALS Act will temporarily allow a full deduction for business meals through December 31, 2020 to stimulate restaurant businesses.

Liability Protection

The HEALS Act will provide immunity for businesses, schools and healthcare providers from lawsuits brought against them for exposure to the COVID-19 by increasing the at-fault threshold to gross negligence and intentional.  However, Democrats already have expressed their no-nonsense to this provision.

Second Round of Stimulus Payment

The second round of stimulus payment is structured identically to the rebates made to taxpayers in the spring.  The Act provides $1,200 stimulus payment for single taxpayers and $2,400 for married couple, plus $500 additional payment for each eligible dependent.  Again, the payment amount will be phased out for those with income over $75,000 for single and $150,000 for joint taxpayers.

Extension of Federal Pandemic Unemployment Compensation (FPUC)

The Act would extend the FPUC for two more months through September 2020 at a reduced benefit of $200 per week from $600 per week.  Starting in October, the FPUC will be replaced with a payment that would represent 70 percent of a recipient’s lost wage combined with state unemployment insurance compensation up to $500 per week.
